Privacy Notice

This Privacy Notice explains how AscendLux, LLC ("AscendLux," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit www.ascendlux.com, use an AscendLux account or portal, request or reserve a consigned experience, communicate with us, attend or support a fundraising event involving our experiences, redeem or travel on an experience, or otherwise interact with us (collectively, the "Services").

Important: AscendLux provides luxury consignment experiences to nonprofit organizations and their supporters. As a result, we may receive information directly from you, from a nonprofit or event organizer, or from travel, booking, payment, and fulfillment providers involved in delivering an experience.

If you do not agree with this Notice, please do not use the Services or provide personal information to us. Questions or privacy requests may be sent to info@ascendlux.com.

1. Scope of This Notice

This Notice applies to personal information that AscendLux handles online and offline in connection with the Services. It does not apply to the independent privacy practices of nonprofits, event organizers, hotels, airlines, tour operators, payment processors, booking partners, or other third parties. Those parties may provide their own privacy notices and are responsible for their own practices.

2. Personal Information We Collect

Information you or an organization provides

Depending on how you interact with us, we may collect:

  • Contact and professional information. Name, organization, job title, mailing address, email address, telephone number, and communication preferences.
  • Account information. Login credentials, account identifiers, organization affiliation, and records associated with a partner or customer account.
  • Event and transaction information. Event or drawing details, selected experiences, reservation and order details, winning bid amounts, invoices, payment status, and related correspondence.
  • Winner, traveler, and guest information. Names, contact details, travel dates, booking preferences, guest details, and other information reasonably needed to arrange or fulfill an experience. A nonprofit or event organizer may provide this information to us after a sale or award.
  • Payment information. Billing contact details, payment method, and transaction records. Payment-card and bank-account information may be collected and processed directly by payment processors; AscendLux generally receives transaction confirmation rather than full payment credentials.
  • Communications. Messages, inquiries, support requests, feedback, survey responses, and other information you choose to provide by email, telephone, forms, or other channels.

Information collected automatically

When you use our website or online Services, we or our service providers may automatically collect limited technical and usage information, including:

  • Internet Protocol (IP) address, browser type, operating system, device type, language, and general location inferred from IP address;
  • pages viewed, links selected, referring and exit pages, date and time of access, login events, and other interactions with the Services; and
  • diagnostic, security, error, and performance information.

We do not intentionally collect precise GPS location through the website. The online Services may use cookies, pixels, local storage, session identifiers, and similar technologies as described in Section 5.

Information from other sources

We may receive personal information from nonprofit clients, event organizers, winning bidders or travelers, booking and fulfillment providers, payment processors, professional advisers, referrals, public sources, and other parties involved in a transaction or relationship with AscendLux. We use that information only for the purposes described in this Notice or as otherwise disclosed when it is collected.

Sensitive personal information

AscendLux does not seek to collect government identification numbers, biometric identifiers, health records, precise geolocation, or other sensitive personal information through its general website. In limited circumstances, a traveler may voluntarily provide information about accessibility, dietary, or similar needs so that an experience can be arranged. We use such information only as reasonably necessary to address the request, share it only with relevant fulfillment providers, and retain it only as needed for that purpose or as required by law. Please do not provide sensitive information that is not necessary.

3. How We Use Personal Information

We may use personal information to:

  • provide, administer, and improve the Services;
  • create and manage partner or customer accounts;
  • respond to inquiries, prepare proposals or quotes, reserve experiences, confirm sales, issue invoices, process payments, and maintain transaction records;
  • coordinate booking, redemption, travel, guest services, substitutions, and fulfillment with relevant providers;
  • communicate with nonprofit clients, event organizers, winning bidders, travelers, and service providers;
  • send operational notices and, where permitted, marketing communications;
  • analyze usage, improve performance and content, and understand the effectiveness of our communications;
  • protect the security and integrity of the Services, prevent fraud and misuse, and enforce agreements;
  • comply with law, tax and accounting obligations, legal process, and requests from authorities; and
  • establish, exercise, or defend legal claims and support a merger, financing, acquisition, reorganization, or sale of all or part of our business.

4. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary:

  • Travel, booking, and fulfillment providers. Hotels, airlines, tour operators, destination partners, concierge or guest-service providers, certificate issuers, and other providers needed to arrange or deliver an experience.
  • Nonprofits and event organizers. To confirm reservations, sales, awards, bidder information, payment status, or fulfillment matters connected with their events.
  • Business service providers. Website hosting, cloud storage, email, customer relationship management, information technology, security, analytics, communications, document management, payment processing, accounting, and professional support providers.
  • Professional advisers. Lawyers, accountants, auditors, insurers, and consultants who are subject to appropriate confidentiality obligations.
  • Authorities and other parties for legal or safety reasons. When we believe disclosure is required by law or legal process, or is reasonably necessary to protect rights, safety, security, property, prevent fraud, or enforce agreements.
  • Business transaction parties. Actual or prospective buyers, sellers, lenders, investors, and advisers in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets, subject to appropriate safeguards.
  • At your direction or with your consent. When you request, authorize, or reasonably expect the disclosure.

Third-party providers may process information under their own privacy notices when they act independently. AscendLux does not control those independent practices.

5. Cookies and Similar Technologies

Our website and online Services may use cookies and similar technologies for the following purposes:

  • Strictly necessary and security. To operate the website, maintain sessions and logins, remember privacy choices, balance traffic, and protect against misuse.
  • Preferences and functionality. To remember settings and improve convenience.
  • Analytics and performance. To understand visits and interactions, diagnose problems, and improve the Services.

You can control many cookies through your browser settings. Blocking cookies may affect login, navigation, or other functionality. If we deploy nonessential advertising or analytics technologies that require consent or an opt-out under applicable law, we will provide the required controls at or before collection.

6. Sale, Sharing, and Targeted Advertising

AscendLux does not sell personal information for money. Based on our current practices, we also do not share personal information for cross-context behavioral advertising or process personal information for targeted advertising or qualifying automated profiling. We may disclose information to service providers and transaction partners for the business purposes described in this Notice; those disclosures are not intended as sales. If our practices change, we will update this Notice and provide any legally required notice and opt-out method.

7. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Notice, including to maintain accounts; administer reservations, transactions, travel, and guest support; meet tax, accounting, insurance, contractual, and legal obligations; resolve disputes; and protect the Services. Retention periods vary according to the type of information, the nature and duration of the relationship or experience, legal requirements, and operational needs. When information is no longer needed, we take reasonable steps to delete, anonymize, or securely isolate it, subject to backup and legal-retention requirements.

8. Information Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system, transmission, or storage method is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your account credentials and for using the Services through a secure device and connection. If you believe your interaction with us is no longer secure, contact us promptly at info@ascendlux.com.

9. Your Choices

Marketing communications

You may opt out of promotional email by using the unsubscribe link in the message or by contacting us. We may still send nonmarketing communications concerning accounts, reservations, invoices, travel, fulfillment, security, or other transactions. If we send promotional text messages, you may opt out as explained in the message, such as by replying STOP.

Account and contact information

You may ask us to update inaccurate contact or account information. We may retain information needed to complete transactions, preserve business records, comply with law, or protect legal rights.

Browser controls

You may adjust cookie settings in your browser. Some browsers and extensions transmit Global Privacy Control or other opt-out preference signals. Where we are legally required to recognize such a signal and the signal applies to our practices, we will treat it as a valid opt-out request. Because AscendLux does not currently sell or share personal information for targeted advertising, such a signal may not change our current processing.

10. U.S. State Privacy Rights

Depending on your state of residence and whether the applicable law covers AscendLux or the particular information, you may have rights to:

  • confirm whether we process your personal information and obtain access to it;
  • correct inaccurate personal information;
  • request deletion of personal information, subject to legal exceptions;
  • receive certain personal information in a portable format;
  • obtain information about categories of personal information, sources, purposes, and recipients;
  • opt out of sale, sharing for cross-context behavioral advertising, targeted advertising, or certain profiling;
  • limit certain uses or disclosures of sensitive personal information;
  • appeal a decision on a privacy request where applicable; and
  • not be discriminated against for exercising a privacy right.

These rights are not absolute. We may deny or limit a request when permitted by law, including when we cannot verify your identity, an exception applies, or the information is maintained in a business or employment context that the law does not cover.

How to submit a request

Email info@ascendlux.com with the subject line "Privacy Request," or write to the address in Section 15. Please describe the right you wish to exercise and provide enough information for us to locate the relevant records.

We will take reasonable steps to verify your identity and authority before fulfilling a request. We may verify through an email address, telephone number, account, transaction details, or other information already associated with you. We will use information submitted for verification only to process the request, prevent fraud, and keep legally required records. An authorized agent may submit a request where permitted by law, but we may require proof of authority and verification from the consumer. If applicable law provides a right to appeal, you may appeal by replying to our decision or emailing info@ascendlux.com with "Privacy Appeal" in the subject line.

California notice

For California residents, the categories of personal information AscendLux may have collected during the preceding 12 months include:

  • Identifiers and contact information, such as name, postal address, email address, telephone number, IP address, account name, and online identifiers;
  • customer-record information, such as contact, account, billing, and transaction information;
  • commercial information, such as experiences selected, reserved, sold, awarded, redeemed, or purchased; event details; invoices; and payment status;
  • internet or electronic activity, such as website interactions, login events, device and browser information, and referral information;
  • approximate geolocation, such as general location inferred from IP address;
  • professional information, such as organization affiliation and job title; and
  • sensitive personal information in limited circumstances, such as account credentials or voluntarily provided accessibility or dietary information used only to provide requested services.

We collect these categories from you, nonprofits and event organizers, travelers or guests, transaction and fulfillment providers, service providers, and automatically from devices. We use and disclose them for the purposes and to the recipient categories described in Sections 3 and 4. Retention is described in Section 7. AscendLux does not use sensitive personal information to infer characteristics. AscendLux has not sold personal information for money and, based on current practices, has not sold or shared personal information for cross-context behavioral advertising during the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16.

11. Children's Privacy

The Services are intended for adults and organizations, not children under 18. We do not knowingly collect personal information directly from children under 13 or knowingly sell or share personal information of individuals under 16. If you believe a child has provided personal information to us, contact us so we can investigate and take appropriate action. Information about a minor traveler may be provided by a parent, guardian, nonprofit, or event organizer when reasonably necessary to arrange an experience; the submitting adult is responsible for having authority to provide it.

12. Third-Party Websites and Services

The Services may link to or involve third-party websites, booking systems, payment processors, travel providers, social networks, or other services. AscendLux is not responsible for the privacy, security, or content practices of those third parties. Review their notices before providing personal information.

13. International Processing

AscendLux is based in the United States, and personal information may be processed in the United States and in destinations where an experience is arranged or fulfilled. Privacy laws in those locations may differ from those where you live. When required, we use appropriate measures for transfers of personal information.

14. Changes to This Notice

We may update this Notice to reflect changes in our practices, technology, Services, or legal obligations. The "Last updated" date identifies the current version. We may provide additional notice of material changes when required by law. We encourage you to review this Notice periodically.
